Can a company ask you if you have been vaccinated? Lawyers say yes
WAUSAU, Wisconsin (WAOW) – This is a question that many businesses face. Can they request or even demand that their employees be vaccinated?
“As a business owner, I think I would like to make sure everyone has the vaccine so that I know people are ready to join my group. My team is safe for me, my family, my colleagues and my customers, ”said Pedro Pineda, owner of Restaurant Jalapenos.
Can they do it?
The lawyers say yes.
“An employer who asks this question and didn’t get the answer he wanted or didn’t get an answer at all, could possibly fire or not hire that person,” said lawyer Tim Kostka.
The reason? Experts say HIPPA does not apply to them.
“They are not a HIPPA covered entity. So asking this question and frankly posting the answer to that question would not violate HIPPA or be regulated by HIPPA just because they are not a covered entity, ”Kostka said.
Covered entities include healthcare providers, healthcare plans and healthcare clearinghouses.
Whether you’re heading to a business, restaurant, or even a job, it doesn’t violate your rights when someone asks you to.
It doesn’t always mean you have to respond.
A company may ask you to provide proof that you have been vaccinated. If you decide not to overdo it, then entry into this business might be denied.
As these companies would be completely within their rights.
